Court allows putative class action to proceed, holds do-not-call protections apply to text messages

Recently, the U.S. District Court for the Northern District of Illinois denied a car dealership’s motion to dismiss a putative class action alleging violations of the TCPA’s do-not-call (DNC) provisions. The plaintiff alleged that the defendant sent her multiple unsolicited telemarketing text messages after she registered her phone number on the national DNC Registry, in violation of 47 U.S.C. § 227(c)(5) and its implementing regulation, 47 C.F.R. § 64.1200(c)....
