04.17.26 Update: Since the publication of this post, the U.S. Court of Appeals for the Seventh Circuit has addressed a key open question surrounding the 2024 amendment to the Illinois Biometric Information Privacy Act (BIPA): whether the amendment applies retroactively to cases that were already pending when the legislation was enacted.
