English High Court Clarifies Scope of Legal Advice Privilege

In a judgment handed down on 16 April 2026 (the Judgment), the English Commercial Court (the Court) in Aabar Holdings SARL & Others v Glencore PLC & Ors1 held that certain intra-client communications and documents may attract legal advice privilege where they are created for the dominant purpose of obtaining legal advice, providing welcome clarity in an area of prior uncertainty.
