High Court confirms only certain actions in tort are available when seeking to recover crypto assets

Following the enactment, in December 2025, of the Property (Digital Assets etc) Act 2025 (the “Act”), the High Court handed down a judgment on 10 March 2026 in which Mr Justice Cotter confirmed the Law Commission's conclusion, reached in the report it produced in the lead up to the Act, that the tort of conversion is not available to a claimant seeking recovery of a digital asset.
